Terms for Chail Plus and Chail Unlimited

1. Provider and scope

These terms apply to contracts for the plans Chail Plus and Chail Unlimited between you and the provider named in the Imprint (“we”). You can use the Chail app itself for free; these terms cover the paid plans. Contact: support@chail.app.

2. What you get

You get the features of the plan you choose, as described on our website and in the app at the time you buy it. The plan belongs to your Chail account (your email address) and applies on every device signed in with that account. Your emails stay on your device and with your email provider; we never receive them.

3. How the contract is made

You choose a plan on our website or in the app and pay through our payment provider Stripe. The contract is made when you complete the payment. You get a confirmation by email. The contract languages are English and German.

4. Prices and payment

All prices are final prices in euros. Chail Plus: €3.99 a month or €35.88 for one year. Chail Unlimited: €9.99 a month or €83.88 for one year. You pay in advance for each period, with the payment methods Stripe offers when you buy.

5. Term and cancellation

A monthly plan runs from month to month. A yearly plan runs for one year and then continues month to month at the follow-up price (Plus €2.99, Unlimited €6.99 a month), cancellable every month; it never renews for another year. Before your first year ends, we send you a reminder.

You can cancel at any time: in the app (Settings, Plan), with the link in your emails, on the page Cancel your plan (at the bottom of every page) or by email. Cancelling takes effect at the end of the period you paid for; your plan keeps working until then. Your right to terminate for good cause remains unaffected.

6. 14 days money back

In addition to your statutory right of withdrawal: if you cancel or withdraw within 14 days of buying, you get the full amount you paid back, and the plan ends right away. After that, we do not refund partial periods.

7. Right of withdrawal

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is made. To exercise your right of withdrawal, you must inform us (provider, address and telephone number in the Imprint, email support@chail.app) of your decision to withdraw from this contract by a clear statement (for example an email). You can also use the page Withdraw from contract or the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw. We will carry out the reimbursement using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result. Because of our promise in section 6, you pay nothing for the time you already used the plan.

Model withdrawal form. (Complete and return this form only if you wish to withdraw from the contract.) To the provider named in the Imprint, email support@chail.app: I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service: ______ / Ordered on (*): ______ / Name of consumer(s): ______ / Address of consumer(s): ______ / Signature of consumer(s) (only if this form is notified on paper) / Date. (*) Delete as appropriate.

8. Availability and changes

We take care that Chail runs reliably; short interruptions, for example for updates, can happen. Features keep developing; we do not take away essential features of a paid plan during a period you paid for.

9. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are only liable for breaches of essential contractual duties, limited to the foreseeable, typical damage. We are not liable for the services of your email provider or for the content of other people’s emails.

10. Privacy

How we handle data is described under Privacy.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another EU country, the mandatory consumer protection rules of that country remain unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
